Freedom of Information Application

We hereby request, under the Freedom of Information Act, copies of the following documents relating to the Australian Broadcasting Authority's involvement in the classification of Internet Content.

(a) copies of any documents, correspondence or reports relating to complaints received under Part 4 of the Broadcasting Services Amendment (Online Services) Act;

(b) copies of any documents, correspondence or reports relating to investigations of Internet content made by the ABA;

(c) copies of any documents, correspondence or reports concerning requests made by the ABA for classification of Internet content by the Office of Film and Literature Classification;

(d) copies of any documents, correspondence or reports concerning decisions on classification of Internet content made by the Office of Film and Literature Classification following a request by the ABA;

(e) copies of any documents, correspondence or reports concerning Interim, Final or Special takedown notices issued by the ABA;

(f) copies of any documents, correspondence or reports concerning any blocking requests issued to Internet Service Providers or Filter Software suppliers;

(g) copies of any documents, correspondence or reports concerning any other action taken by the ABA in response to a complaint, e.g. rejection of a complaint with or without referral to the OFLC;

(h) copies of minutes, or relevant extracts thereof, of meetings relating to items (a) to (g) above;

(i) copies of any memo, post-it message or accompanying "with compliments" note relating to items (a) to (g) above;

By way of clarification, our interest is in the identity of Internet sites that have been the subject of complaint to, and/or investigation by, the ABA, and the outcomes of such investigations. We have no interest in the identity of complainants, except in the case of investigations initiated by the ABA, another government agency, a government Minister, or a Member of Parliament.

The period of time covered by this request is from the start of operation of the Internet regulatory regime on 1st January 2000 until the date of commencement of processing of this application.
